Excel IT Expert ("we," "us," or "our") provides advanced technical services, including Cloud Infrastructure management, Custom Software Development, and Artificial Intelligence integration.

By engaging our services or using our solutions, the Client ("you") acknowledges the inherent risks associated with emerging technologies and agrees to the following terms.

1. Artificial Intelligence (AI) Usage & Limitations

Our solutions often utilize Large Language Models (LLMs) and Generative AI technologies (e.g., OpenAI, Anthropic, AWS Bedrock). You acknowledge the following specific characteristics of AI:

Accuracy & Hallucinations: Generative AI is probabilistic, not deterministic. It may occasionally produce content that appears factually correct but is false, misleading, or nonsensical (known as "hallucinations"). Excel IT Expert does not guarantee the accuracy of AI-generated outputs. You agree to verify all AI outputs before using them for critical business decisions.
Bias & Content: AI models are trained on public datasets and may inadvertently reflect biases or stereotypes. While we implement guardrails and prompt engineering to mitigate this, we cannot guarantee that all outputs will be free of bias or offensive content.
Non-Determinism: AI models may provide different answers to the same prompt at different times. We cannot guarantee 100% consistency in AI responses.

2. Cloud Infrastructure & Third-Party Reliance

Our services rely heavily on third-party cloud providers (primarily Amazon Web Services - AWS, but also Google Cloud, Azure, and others).

No Control Over Providers: We do not own or control these third-party platforms. We are not liable for service interruptions, downtime, data loss, or API failures caused by the cloud provider.
Service Sunsetting: If a third-party provider discontinues a specific tool, API, or model that your project relies on, we will assist in migrating to an alternative, but we are not responsible for the discontinuation itself.
Cost Management: While we design infrastructure for cost optimization, cloud costs are variable based on usage. You are responsible for all direct costs billed by the cloud provider unless explicitly stated otherwise in our agreement.

3. Software Development & MVP Risks

As we specialize in Minimum Viable Products (MVPs) and rapid scaling for startups:

"As Is" Basis: Custom software is complex. While we adhere to high coding standards and testing protocols, we do not warrant that our software will be completely error-free, bug-free, or uninterrupted.
Scalability: Systems designed for an MVP (early-stage) may require refactoring or rebuilding to handle enterprise-level scale later. We design for growth, but architectural changes are a normal part of the software lifecycle.

4. Security & Data

Shared Responsibility: We implement industry-standard security measures (Encryption, IAM, Firewalls). However, you acknowledge that no system connected to the internet is impenetrable. We cannot guarantee absolute immunity from cyber-attacks or unauthorized access.
Credential Security: You are responsible for maintaining the confidentiality of any administrative logins or API keys provided to you.

5. No Business Guarantees

We provide the technical foundation for your business. However:

We do not guarantee that the technology we build will result in successful funding rounds, user acquisition, or profitability.
We do not provide legal advice regarding the copyrightability of AI-generated content or the compliance of your business model with local laws.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Excel IT Expert accepts no liability for any loss of revenue, loss of data, or reputational damage arising from the use of AI outputs, cloud outages, or software malfunctions.
